Can Pierre Palmade escape prison, as some Internet users claim?

At the end of a media trial, the actor Pierre Palmade was sentenced to five years of imprisonment, three of which were suspended, i.e. two years, for aggravated involuntary injuries, after having caused a road accident under the influence of narcotics. According to some commentators, the actor will never set foot in prison. But is this really the case?

Warrant of deposit with deferred effect

The two years of confinement are accompanied by a deposit mandate with deferred effect, with provisional execution. Translation: Pierre Palmade does not immediately go to prison, but he will not be able to avoid it either.

The Code of Criminal Procedure provides that, in the deferred committal warrant, the convicted person will be summoned within one month by the public prosecutor who will explain his conditions of detention, his penitentiary establishment and his date of incarceration.

This entry into prison cannot be set beyond a period of four months after the prosecutor's hearing. Pierre Palmade will therefore be imprisoned no later than April 20, 2025.

Provisional execution of sentence

Let us not forget the provisional execution of this sentence. Even if the actor appeals his conviction, which, in principle, should suspend it, it still applies and will not save him from prison.

As his sentence is more than one year's imprisonment, it cannot be amended. However, he may request it during his incarceration.
