Strength and determination
Attorney General Valérie Schaaps contradicts the theory of the accused who claims to have given his son Faïssal a weak stab to threaten him and end the fight in which he was involved. “I cannot imagine that this is the case when one is stabbed in the back. This blow was delivered with a thrust and perforated the lung. The blade was held with determination. He did not simply ' stung his son, as he claims, because, without medical intervention, Faïssal Hassar would have died.underlined the Advocate General.
The public prosecutor insists on the qualification of murder to be used against Mohammed Hassar concerning the acts committed against his son Bilal. “The blow was struck in the thorax of his son and caused death. The knife was plunged under the sternum and the deep wound between the ribs pierced the lung and tore the pulmonary artery. This blow struck thrust caused massive hemorrhage”detailed the attorney general.
Ms. Schaaps insists on the voluntary nature of the action committed by Mohammed Hassar. The blow was delivered with force, which requires a certain determination. This blow reached a lethal zone.
Technically impossible
The prosecution also dismissed certain arguments that should be raised by the defense, such as reasonable time. Mohammed Hassar's lawyers believe that the delay since the facts could have affected certain elements of evidence, such as testimonies. The Advocate General considers that the time that has passed since the facts did not affect the testimony, nor did it infringe the rights of the defense.
Finally, the public prosecutor considers that self-defense cannot be upheld in favor of the accused. There is no evidence that Mohammed Hassar would have been targeted by an attack by his son Bilal and that he would have had no other means than to kill him to escape serious danger. Mohammed Hassar claims to have turned the knife that his son was brandishing against him, but the prosecution believes that this gesture is technically impossible.
Defense lawyers will plead this Monday afternoon.
