Workplace harassment case at Leclerc in Aire-sur-l’Adour: department manager acquitted

She was accused of moral harassment by six of her colleagues and/or former colleagues. A 57-year-old department manager at the Leclerc supermarket in Aire-sur-l’Adour (Landes) was acquitted this Tuesday, September 17 in the evening by the Mont-de-Marsan criminal court. The case dates back to 2020, she was due to be tried earlier but was postponed several times. When it comes to harassment at work, it is difficult to characterize the facts.

The case was solid, however, according to the prosecution. The Labor Inspectorate investigated. The agent in charge of it was present at the hearing. She presented the results. It was she who went to look for testimonies from former employees of the same departments. In the end, while almost no one wants to talk to her in the store – she describes a real code of silence – she nevertheless collects the testimony of these six women.

An investigation by the Labor Inspectorate

They all describe the same facts: an all-powerful, virulent, mocking, denigrating manager. The conclusions of the report are clear: the facts of harassment are characterized. Authoritarian behavior, isolation, devaluation of work, all repeated. But Of the six witnesses cited, only one filed a complaint.only one went through with it, was present at the trial.

In the aisles of a supermarket, there is no writing, it is one word against another. The defendant denies everything en bloc. Before the judges ruled in her favor. On leaving, the only one who dared to testify blurted out: “I would have tried everything, too bad. I would have gone all the way. Now it’s finally over.”. On Tuesday evening, the prosecutor did not yet know whether or not he wanted to appeal. The department manager continues to work at Leclerc in Aire-sur-l’Adour.
