IThere were more than 5 million following her on the social network TikTok before her account was banned. Ophenya, whose real name is Ophélie Vincent, a 24-year-old content creator, is in the sights of justice after a report from the whistleblower collective “Mineurs Ethiques et Réseaux” (Meer). A week earlier, one of the members of the collective was able to record the influencer's live performance, which included a minor among her subscribers.

An action which will cost Ophenya dearly, which is clearly not its first attempt according to the collective, because it contravenes the rules of TikTok which prohibit minors from live broadcasting. But, much more than the inaccessibility of her account, Ophenya is at great risk: according to information from our colleagues at Politico, the Miviludes (Interministerial Mission for Vigilance and the Fight against Sectarian Abuses) recently took legal action under article 40 of the Code of Criminal Procedure. Ophenya already singled out by a socialist deputy

The young woman's harmful influence sparked reactions, including from certain subscribers, tired of hearing her claim that she could “change the world”. This form of control that Ophenya would exercise over her young followers had already been denounced on April 9, 2024 by the socialist deputy Arthur Delaporte as part of the examination of the bill against sectarian abuses.

If at the time, Ophenya had filed a complaint against the MP for defamation, the report made by Miviludes against him to the prosecutor's office risks changing the situation.

After stopping her master's degree in psychology to prioritize her social networks launched during the second confinement, Lyonnaise Ophélie Vincent was able to join the prestigious content creator agency Webedia, alongside Joyca, Inoxtag and the ex-host Jamy Gourmaud. On November 7, 2023, Ophélie Vincent was one of the rare influencers invited by Gabriel Attal, still Minister of National Education, as part of the day to combat school bullying. An invitation that MP Arthur Delaporte will not fail to recall in his speech to the Assembly a few months later. “Gift giving on TikTok, compulsive presence on the social networks of the influencer at very wide time ranges, from breakfast to evening, heightened sense of belonging, pack behavior towards fans who leave the community… In short, an explosive cocktail,” explains the MP before adding that “unfortunately, the government has recognized her as one of the watchdogs in its fight against school bullying.”

Indeed, if Ophenya had been invited by the ministry teams, it was because the influencer, who claims to have been the victim of school harassment during her youth, had launched on her social networks, during a live broadcast with her subscribers , a movement to recognize harassment, in the form of a discreet hand gesture, inspired by that reserved for victims of domestic violence.

But this invitation had already raised questions at the time, as the timing was not to the government's advantage. Indeed, three days earlier, on November 4, 2023, Ophenya unleashed the wrath of other content creators by promoting a dating application “for 10-21 year olds”. Initially called “Crush” (translate crush), the application promoted by the influencer offered young users the opportunity to respond to anonymous surveys on other students in their establishment registered thanks to the activation of the geolocation of their smartphone. A paid option of 3.99 euros per week was even available so that middle and high school students could find out “who secretly admires them”.

Since then, despite the suspension of the influencer's main account, a second one is still active, as is her Instagram profile followed by nearly 800,000 people. She also still offers live shows on her YouTube channel, with 683,000 subscribers, like those she previously broadcast on TikTok.

On November 20, Ophélie Vincent invited her subscribers to try to win a trip with her to Dubai… while claiming a few hours later to have filed a complaint during the day. “The lie takes the elevator but the truth takes the stairs!” I’m fighting against cyberbullying, so of course I won’t give up, you can count on me,” she says in a story posted on her Instagram account.
