The Consejo Superior de Deportes (CSD) granted this Wednesday the urgent precautionary measure requested by FC Barcelona and players Dani Olmo and Pau Víctor. Both players will not be able to be on the field this evening because the license arrives on Thursday, but they would be available in a hypothetical final, if Barça wins the semi-final against Athletic.
This measure, which is provisional until the final resolution of the appeal filed by the club and the aforementioned players, suspends the agreement of the Monitoring Committee of the RFEF-LaLiga coordination agreement, dated January 4, 2025, and the cancellation of the sports licenses of the aforementioned players.
Likewise, it maintains the validity of these licenses until the definitive resolution of this appeal, in accordance with the Consejo Superior de Deportes.
To take this urgent precautionary measure, the CSD analyzed the appeal, which is 52 pages long, and the more than 60 documents that accompany it. In their arguments, the FC Barcelona, Dani Olmo (26 years) et Pau Víctor (23 years old) recall that the Monitoring Commission is exclusively responsible for interpreting the application of the clauses of the RFEF-LaLiga Coordination Agreement, for monitoring compliance with the agreement and for promoting any other activity aimed at greater efficiency of the agreement.
Competences of the Monitoring Commission
They therefore question the competence of the Monitoring Commission to grant or not the prior authorization or the final license for professional football players and consider that the Agreement of the Monitoring Commission of the RFEF Coordination Agreement- LaLiga is legally null and void.
Without prejudice to the allegations that may be requested for the resolution of the merits of the case, the CSD observed the possible concomitance of a cause of total nullity and the existence of immediate and difficult to repair damage, which would affect the rights recognized in the current Sports Law to footballers Dani Olmo and Pau Víctor and their legal security.
-Economic and sporting harm if it is not granted
In this sense, the CSD assessed that, according to Article 27 of the Sports Law, professional athletes have the right “to a sporting career in accordance with their potential” and with all the guarantees and certainties.
At the moment, FC Barcelona and its players are immersed in the Spanish Super Cup, the first official title of the season, with global visibility and repercussions, in which only the teams that have obtained the best results in the competitions participate nationals of the previous season.
The CSD considers that failure to adopt this precautionary measure would cause serious economic and sporting harm to the club and, above all, to the players. It could also harm the interests of the Spanish national team, as well as the rest of the domestic competitions, including LaLiga.
Finally, the CSD emphasizes that this decision does not prejudge the substantive questions raised in the appeal.
