Examined during two days of hearing Monday and Tuesday, this request must be judged by the magistrate Eleonora Arenas. The latter, who chaired the hearing behind closed doors, could make her decision immediately after the debates. According to the lawyer for the players of the XV of France, the decision on a possible dismissal was finally put under advisement, without a date being communicated.
An appeal in the event of dismissal?
It will therefore be necessary to wait several days before knowing whether the dropping of proceedings against the players has been decided. This Tuesday, it was the plaintiff's lawyer Natacha Romano, who pleaded her opposition to the dismissal of the case. The prosecution (which pleaded for dismissal) and the players' lawyers spoke on Monday. “The judge will decide the result, and will take (the) few days necessary, announced Rafael Cuneo Libarona, lawyer for the players, this Tuesday. It’s a complicated case.” He added that the judge “didn’t say” how long it would take to make its decision.
If a dismissal of the case were to be pronounced, the plaintiff's lawyers would have three working days to appeal the decision, to the Collegiate Court of Mendoza. Natacha Romano has already announced that she intends to do so. A confirmation of the dismissal on appeal would definitively close the case, with a total dropping of the charges.
