United States: TikTok application threatened with ban

The TikTok application risks being banned from Sunday in the United States following the confirmation by the American Supreme Court of a law requiring ByteDance, parent company of TikTok, to put its video sharing platform up for sale.

Enacted by a bipartisan majority of Congress in 2024, the law warns of the national security “threat” posed by TikTok, which could be used to gather information about Americans or covertly influence the US public by amplifying or removing certain content.

In its judgment, delivered Friday, the Supreme Court ruled that the right to freedom of expression, provided for in the 1st Amendment to the constitution, must give way to concerns related to the national security of the United States.

In reaction to this judgment, the popular application declared that it will “unfortunately be forced to close on January 19”, unless “the government of Joe Biden guarantees the non-application of the law”.

Some 170 million Americans use TikTok. A recent survey from the Pew Research Center showed that 17% of American adults consult the news on this platform, a jump of 500% compared to 2020.

According to experts, cited by the press, the application will be removed on Sunday from the download platforms of Apple and Google, which would be subject to fines under the law if they continue to host the application.

For users who already have the application on their phones, access to TikTok will still be guaranteed, but without the possibility of updates.

The ban on TikTok could be suspended if President-elect Donald Trump, who is sworn in on Monday, decides to intervene.

Mr. Trump had announced his intention to “save” TikTok. On Friday evening, he said on social media that his decision “will be made in the not too distant future. But I must have time to examine the situation”.
