The special prosecutor who investigated the two federal proceedings against Donald Trump, Jack Smith, left the Department of Justice after transmitting his report to Minister Merrick Garland, according to court documents released Saturday.

The special prosecutor recommended and obtained at the end of November a halt to federal proceedings against Donald Trump for illegal attempts to reverse the results of the 2020 election, and for withholding secret and confidential documents after his departure from the White House.

After consultations, the Justice Department concluded that its own policy since the Watergate scandal in 1973, of not prosecuting a sitting president, “applies[ait] to this “unprecedented” situation, he explained.

Jack Smith finalized and sent his confidential report on January 7 to the Minister of Justice concerning the investigation of these two cases.

The minister plans to make public the report on accusations of electoral interference in 2020 and transmit it to Congress.

However, he indicated that he would not publish the part relating to Donald Trump’s retention of classified documents at his Mar-a-Lago property after his departure from the White House. This is in order not to “prejudice” his two co-defendants who remain prosecuted in this case, namely his two personal assistants.

Jack Smith, a favorite target of Donald Trump’s attacks, left the Department of Justice on Friday, according to court documents presented Saturday in the Florida federal court, which has jurisdiction in this case.

This court temporarily blocked the publication of the report, at the request of Donald Trump’s two co-defendants, but the Department of Justice appealed this decision.
