Born in 2003, Maguette D. combined studies and sport. Very gifted in basketball, she was the hope of her family. Unfortunately, Maguette gave his career a serious blow. Pregnant with her boyfriend, the first grade student gave birth alone in her room on December 26, 2021, around 5 p.m., before dropping her baby. But her cries of distress alerted her mother and her aunt who had just learned of her unwanted pregnancy. Maguette was thus taken to a health facility with her child. When the doctor noticed that the newborn died of asphyxiation, he alerted the investigators. When questioned, Maguette maintains that she had several sexual relations with my lover Ma Absa G. After consultation, the white coat notified his patient that she was pregnant, before giving her an appointment in two weeks for the book to be drawn up. However, Maguette did not return to the hospital. She just informed her lover who recognized the paternity of the child. Despite this, Maguette allegedly killed her baby just after giving birth. “I had contractions from 11 a.m. to 5 p.m. When I saw the baby’s head, I wrapped a scarf around his neck to pull him out. Then, I dropped the child on the tiles,” admitted the defendant. Under arrest warrant since January 5, 2022, Maguette was yesterday at the helm of the Dakar criminal chamber. But, she contested the crime of infanticide, alleging that she had no intention of killing her child. “The moment I put a scarf around my baby’s neck, I was planning to take him out. I was stressed. I didn’t even know what I was doing,” she cried. “I was afraid of my mother’s reaction. That’s why I never revealed my pregnancy to him,” she added. Ma Absa reiterated that he was ready to assume his role as a father. According to him, the accused called him on the phone when she started having contractions. At the time, he said, he was at work. This is how he pointed out a clinic to her. “She didn’t go. In the evening, to my great surprise, her mother called me to tell me that she had given birth. When I went to the hospital, the doctor told me that he had noticed signs of strangulation on the newborn. He did an autopsy and filed a complaint,” recalled Ma Absa G. For the representative of the Public Prosecutor’s Office, the desire to kill is the result of the actions taken by the accused. “If we do not have the will to kill, we do not commit deadly acts,” said the deputy prosecutor who requested five years of criminal imprisonment. Both defense counsel argued that the doctor’s opinion is not sufficient to characterize infanticide. Since, they say, we cannot be certain that the child was born alive. Thereupon, the black robes pleaded acquittal with the benefit of the doubt. But, their client returned behind bars. It will be built on January 21.
