Before the November election, his lawyers invoked presidential immunity to try to quash the charges. They also tried to move the case to federal court, arguing that New York jurisdiction was not appropriate. These steps led to several postponements, pushing Judge Merchan to postpone not only the sentence, but also the decision on the question of presidential immunity, until after the November 5 election.

A postponement or a cancellation?

If the judge announces a postponement for the moment, he also does not rule on the argument of presidential immunity put forward by Trump's lawyers. The re-elected president, however, got his lawyers to file a new request in order to simply have the case canceled.

In a letter to the judge, Manhattan District Attorney Alvin Bragg acknowledged that Trump was unlikely to be convicted before the end of his term. This Democrat, however, pleads for Trump's conviction to be upheld.
