Could the calculation error made by the Federal Social Insurance Office (OFAS) on AVS health have changed the result of the vote on women’s retirement age? The question will have to be decided by the courts after an appeal by the Greens, and the Federal Court has just announced a public deliberation on December 12, “24 Heures” revealed on Friday.

This decision, while the court often does its work behind closed doors and then communicates it in writing, could mean a disagreement between the judges, argues the “Tages-Anzeiger”. Who quotes the president of the Greens Lisa Mazzone: “We are happy that the decision is made again this year, before the retirement age increases.”

The Appellant also welcomes the presence of two women among the five judges who will deal with the case. Questioned by the Zurich daily, the Federal Court explains that the regulation forces the presidency to include members of both sexes in procedures where “the nature of the dispute justifies it”. This is why two federal judges were invited to participate in the judgment.

As a reminder, the OFAS had presented erroneous projections on the AVS forecasts, false by almost five billion francs. The complainants believe that the vote on the retirement age of women, extremely close with a majority of only 50.6% of voters, could have had a different outcome if the correct figures had been presented from the start.
