The Paris Court of Appeal on Thursday ordered the blocking of several non-European pornographic sites due to the lack of control of the age of users, but granted a reprieve to platforms hosted in the EU.

Seized by child protection associations, the court thus called for the blocking of certain sites “until it is demonstrated that the latter have implemented a control other than purely declarative of what users are major,” she said in a press release.

Among these sites, four major platforms: Tukif, Xhamster, Mrsexe and Iciporno. They must be blocked within 15 days and will remain so until they have put in place a system other than age declaration.

For other sites, hosted in the EU – notably Pornhub and Youporn – and which have raised a question relating to European law, French justice will await a response from the Court of Justice of the European Union (CJEU) to make its decision. decision.

Frédéric Benoist, lawyer for the “La Voix de l’enfant” and “e-Enfance” associations, told AFP he was “disappointed” by the decision. “Major sites are escaping a blockage that should be imposed,” he regretted.

After the adoption in May of the law aimed at securing the internet (Sren), the audiovisual regulatory authority (Arcom) published at the beginning of October a framework to regulate the “reliability of checking the age of users” on pornographic sites while respecting their privacy, imposing at least a “double anonymity” system.

According to Arcom, 2.3 million minors visit pornographic sites every month.
