An Issoldunois made death threats in December 2021 and January 2022 against his partner's daughter. He was tried three years later on Monday December 16, 2024. On voice and written messages, the victim could hear or read: “I'm going to kill you, I'm going to take care of you. You're going to receive a surprise in the mail… a ball. » He also sent her the photo of his penis.
Absent from the stand on the day of his trial, the accused explained to the gendarmes who were leading the investigation that his remarks had been formulated “in the heat of the action and the fun”.
Ten months of imprisonment
Concerning the personality of the accused, the president recalled on the day of the hearing that this man's criminal record included “fourteen mentions for a total of thirty-two months of detention” and that he was a consumer “alcohol and cannabis”.
On the side of the civil party, Me Catherine Bayard defended the plaintiff under reinforced guardianship and the Croix Marine du Cher association, judicial agent for the protection of adults. For the lawyer, this man “has a desire to harm” and develop “a worrying animosity”. She requested €800 for moral damages.
“These facts are already old”
For the public prosecutor, “the facts are proven” and reiterated. The prosecutor requested twelve months of detention. Me Jérôme Dubois-Dinant defended the accused and requested “the meaning of this sanction” : “These facts are already old and a citizenship course would be more appropriate,” he estimated.
The court sentenced the author of these threats to ten months' imprisonment with a summons to appear before the sentence enforcement judge. He will have to pay the sum of €700 to the Croix Marine du Cher for damages.
