Amadou Ba, MP for Pastef, proposed a bold reform of the Senegalese judicial system during the conference launching the activities of the Framework for Democratic and Patriotic Reflection (Crdp-50).
Amadou Ba suggested “completely removing the prosecutor from the court”, emphasizing that, in the current system, the person being prosecuted does not have the same opportunities as the prosecutor who directs the procedure. He proposed making the prosecutor independent of the court and separating his functions from those of the magistrates.
Inspired by the Anglo-Saxon model, the trained jurist proposed that prosecutors be appointed by the president and could be lawyers or law professors, seconded from the judiciary.
This reform would aim to balance the powers between the prosecutor and the accused, in particular by limiting certain prerogatives of prosecutors, such as the designation of investigating judges or the issuance of committal warrants without probative evidence.
