Worked in a sawmill

The defendant, who was driving in a vehicle belonging to the sawmill where he is employed, has already been convicted for similar checks, the latest for acts in May 2021 and December 2021. He is a repeat offender, which increases the sentence . He admitted at the hearing that since the facts currently being judged, he has undergone two other tests under the influence for which he will soon return to court.

He was sentenced at first instance to a fine of €3,200, four months’ disqualification and the obligation to retake the four exams. With his lawyer Laurent Michel, he asked the court for a reprieve for the forfeiture, because his job requires him to travel.

President Nazé scolded him: “Your addiction is all the more serious because you work in a dangerous profession. Not only are you putting yourself at serious risk by driving under the influence, but by getting behind the wheel while high on such doses, you are putting other road users at risk. You are unconscious.”

In its reasoning, the court notes in particular that “in order to encourage his efforts and to frame his amendment, a quarter of the fine and the loss of the right to drive will benefit from a probationary suspension of three years. He must refrain from consuming any form of narcotics and produce quarterly certificates to prove it. He will also have to begin medical-psychological follow-up to try to treat his addiction.
