The administrative court of Orléans (Loiret) has just rejected the request of a pharmacy technician from the Chartres hospital center (Eure-et-Loir).
The latter actually wanted her thermal cures continue to be supported by his employer after his work accident.
A workplace accident 20 years ago requiring lifelong care
The November 2, 2021the director of the Chartres hospital center had in fact refused to take charge of the “thermal treatment” of Ms. XXX for the year 2022, a treatment which aimed to treat your pain linked to this accident twenty years ago and who had been recognized “ attributable to the service » by his employer.
The woman, now aged 55, nevertheless suffers from a “ low back pain (…) which goes beyond the scope of a simple back pain” and which “ requires lifelong care“, repeated his lawyer before the administrative court of Orléans. This caused him “hospitalizations”, “drug treatment” and “regular care”.
The Chartres hospital center had also granted him work stoppages “to carry out a thermal treatment » between 2004 and 2021. Faced with the latter's refusal to continue paying for these spa treatments, the employee therefore took legal action. She further demanded 2.500 euros to cover his legal costs.
“Proven treatment effectiveness”
The effectiveness of thermal cure treatment has been demonstrated and (…) rehabilitation stays in thermal centers constitute preventive actions allowing him to escape major spinal operations.
“She has been able to return to her part-time work since 2005 without experiencing a relapse, even though she suffers from partial permanent disability of 15%. »
Effectiveness of cures “questioned by the hospital center expert”
But “the effectiveness of annual spa treatments on chronic lower back pain is (…) called into question by the medical expert contacted by the hospital center”, begins by objecting the administrative court of Orléans in a decision dated October 24, 2024 which has just been made public.
The doctor in question instead advises “ daily muscle strengthening after a period of therapeutic education with a physiotherapist.
Moreover, “the medical assessments produced at the instance (…) are limited to mentioning, for some, an effect “considered beneficial apparently allowing savings on the drug consumption and work stoppages,” noted the Orléans judges.
“It does not appear from any of the documents in the file that the lack of thermal treatment (…) would have the consequence of making it impossible for the person concerned to carry out her duties. »
