After three years of living together, this 53-year-old man did not expect to receive such violence from his partner. The latter hit him four stab wounds in Roubaix (North). However, in this case of domestic violence, both spouses were judged in immediate appearance au tribunal from Lille, December 16. The facts date back to December 12 at 1 a.m., against a backdrop ofalcohol, drugs and money.
Threats, stampedes and stabbings in Roubaix
That day, a violent argument broke out. The man was found with four stab wounds, the 48-year-old woman with bruises on her face. The two defendants have different versions of the facts, which the Lille court will try to clarify.
The police were called to a store in Roubaix. On site, firefighters then took charge of a man whose clothes were stained with blood. They noticed four stab wounds, “light as small dots”, on the man's shoulder and left thigh. Some wounds require stitches but “the vital prognosis is not engaged« .
In a ” obvious drunkenness“, the 53-year-old man explains that he was stabbed by his partner following a violent argument in their apartment earlier in the evening.
“I was bleeding, I left,” he says. The police therefore went to the couple's home and found a woman in her forties who “smelled strongly of alcohol”. Inside, “ very light traces of blood » cover the floor and the knife is found on a coffee table, “surrounded by several crack pipes« .
In court, the president was surprised by the “very common appearance” of the weapon, similar to a steak knife with a “five-centimeter notched blade”.
“Ammonia in the eyes”
Two versions of the facts conflict. According to the defendant, the 53-year-old man stole money from her and did not want to give it back. He then shouted at her to “get out” and attacked her, shoving her violently, pulling her clothes and hair. She adds that she was “ strangled from the front” and indicates having received “ two punches in the face”, at the level of the “left chin”. “He tried to throwammonia in the eyes“, she specifies when she warns the police on the phone.
The man allegedly knocked her to the ground and that's when the 48-year-old woman grabbed the knife from the coffee table and hit her partner.
“I just wanted to threaten him at first, it was bullshit self-defense“, she claims in court. For the defendant, everything is different. According to him, since the end
of her partner's employment contract, “she does not participate financially”.
This is why they would have argued. The 53-year-old man denounces insults and shouting. “I held her as best I could. She has strength, I have more,” he defends himself in court.
He denies all the blows and only admits to having pushed her and pulled her hair “during the fight”. He states that he left the home after receiving the stabbings and tried to disarm his partner: “I’m not going to let her screw me over!” »
“She has a capacity for resilience and combat that I admire!”
For the defendants' lawyers, it is a real challenge to avoid incarceration. Indeed, the couple is used to the prison system and between them, they have 55 mentions on their criminal records. The defendant's lawyer adopts a defensive pleading and describes a “totally weakened” woman, in “thecomplete inability to defend oneself“. “She was marked by life,” she emphasizes, emphasizing the “chaotic journey” of her client.
She finally describes “an extremely toxic relationship” from which the 48-year-old woman must “detach herself”. The defendant's lawyer opts instead for the offensive. For
she is formal: her client “flew away to avoid the blows and put an end” to the argument.
The lawyer overwhelms the defendant. According to her, it is impossible that she was punched twice in the face, had her hair pulled and escaped unscathed. “She has a resilience and combat capacity that I admire! » she quips.
For her, this is proof that her client could not have committed these acts. Furthermore, according to the lawyer, when the 48-year-old woman calls the police, “she tries to clear herself”, saying that she “had a bad evening” or that “for several days, we [la] stolen “. This is why she asks the
court to “show a lot of kindness” towards the man she is defending.
The public prosecutor recalls “ extremely serious facts“. According to her, “madam has always been consistent in her statements”, but she wonders: “If she is threatened, why doesn't she call immediately? » The prosecutor blames a late call to the police, “well after the gentleman arrived at the store” and notified the emergency services himself. She even denounces an “extremely brutal action” and a disproportionate gesture.
According to the prosecutor, the defendant did not act in self-defense. This is why it requires ten months of probationary suspension for the accused and two years of probationary suspension for his spouse. Sentences confirmed by the court, which declared them both guilty. The defendants also receive a contact ban.
