The Brasserie de l’Europe will not reopen before 2025. The Tarn prefecture has just announced the closure of the Castres establishment, located on Place Jean-Jaurès, following the excesses on the night of November 21 to 22. Fifteen days of forced shutdown from December 19 to January 1 and a hard blow for the Gairaud family, in the middle of the Christmas market.
Relying on various legal articles, decrees of the President of the Republic and prefectural orders, Laurent Buchaillat, prefect of Tarn, justifies his decision “considering that under the terms of article L3332-15 of the public health code, it is up to the representative of the State in the department to order the temporary closure of drinking establishments following violations of the laws and regulations relating to attendance or the operating conditions of these establishments, whether it concerns an attack on public order, health, tranquility or public morality, or even criminal or misdemeanor acts.”

He refers to the too late and stormy evening of the third Thursday in November (release of the early wine) which ended in court a few days later. That evening, around 2:30 a.m., the owner’s son violently attacked the police who intervened for a nighttime disturbance when the establishment was past closing time. Prosecuted for contempt, rebellion, death threats and violence, the 25-year-old man was sentenced to one year in prison, including five months. On the stand, in front of the magistrates, he apologized. For his part, the father will soon be tried for contempt.

“Considering that one of the crew of the national police, who came as reinforcement, was injured during the arrest of the manager’s son”, that “this situation led alcoholic and hostile customers to join the crowd , generating a significant disturbance to public order” and that “these events are related to the attendance of the establishment or to its operating conditions”, the prefecture preferred to stop the activity until the end of the ‘year “considering that the only way to prevent the renewal of these disturbances to public order is to take an administrative closure measure”.
The decision is notified and posted on the front door of the Brasserie de l’Europe. The regulations in force provide for the authorization of the opening of beverage outlets for consumption on site between 5 a.m. and 2 a.m.
