The administrative court of Nantes rejected the request “obviously inadmissible » of the mother of a student at a college in La Roche-sur-Yonwho contacted him on June 18, 2024 to complain about a “dispute relating to the rejection of his request for exemption from the school permit”.

“The presidents of the court formation may, by order, reject manifestly inadmissible requests when the court is not required to invite their author to regularize them”, began by recalling the judge in an order of November 6, 2024 which comes to be made public.

Appeal through a dedicated service

“Persons (…) not represented by a lawyer (…) can send their request to the court electronically using a teleservice accessible via the internet,” he explained, referring to the free service. Citizen Telerecoursepublished by the Council of State and which is mentioned in the administrative justice code (CJA). “These people cannot (…) seize the court electronically only by using this teleservice. (…) A request cannot be submitted by email or fax. »

In this case, the mother of the Vendée schoolboy sent your request “by email”explains the judge. “A request for regularization was sent (…) on July 1, 2024,” he said. But the envelope “was not collected” from the Post Office and was therefore “returned to court” on July 22, 2024.

“Since the interested party has been notified and has not removed the envelope, the notification must be deemed to have been duly carried out”, therefore considers the Nantes magistrate. “Thus, Madame did not, within the fifteen day period allotted to her, regularize her request by submitting it by post or via the teleservice. This request (…) is tainted with manifest inadmissibility and can only be rejected. »
