The public rapporteur left them little hope during the hearing on November 26: in its judgment rendered on December 10, 2024, the administrative court of Poitiers rejected the various requests of several residents of the Pont-Neuf district. .
They were concerned about the construction of two buildings planned at 21, rue de la Chatonnerie in Poitiers and contested the building permit issued by Poitiers town hall in 2022.
But the court dismantled all the arguments they had lined up. The building permit is compliant and respects the local town planning plan, being outside the protected area of Poitiers. Certainly, he must “behave on average” 30% of social housing: with 9 social housing out of 34 housing units, the rate of 26.47% “is not incompatible” since it is an average.
No infringement of the right to privacy
Likewise, the court sees no reason to reject the project on the arguments of roads, networks, parking, missing green spaces or location of buildings. The buildings “will not infringe on the right to privacy of the exterior spaces of surrounding individual houses”he believes.
He recognizes that the surrounding neighborhood “is characterized by suburban type housing” but there is no “particular unit” and there is even, “nearby”, “constructions of an industrial nature”. “In addition, the buildings will have facades in a light tone and roofs in orange-toned canal tiles, as will the majority of neighboring buildings. » As a result, the two buildings “do not detract from the character or interest of the surrounding areas”.
As a result, the residents saw their request rejected and were even required to pay 1,300 euros to SARL Vivaprom.
