On July 7, 2024, late in the afternoon, as the gendarmes left their checkpoint in Echauffour (Orne), they noticed that a Peugeot 106 vehicle was swerving several times on the road. Using their sound and light alarms, they set off in pursuit and noticed that two packages had been thrown by the driver they were stopping.

These two packages will be collected, they are two strips of cannabis resin of almost 100 grams. Three other identical ones will be discovered hidden under the seat.

For a party in Seine-Maritime

The driver and his two passengers, three West Indians aged 20, 21 and 23 acknowledge the facts in court. The driver, a certain François (1) aged 23, admits that it was he who threw the two plates out of the window. He explains that they went to get this cannabis in Aube (Orne), near L'Aigle (Orne). He doesn't consume, but it was for a party, near (Seine-Maritime), which was to last a week where everyone had to bring something.

“See how it would pay off”

Michel (1), a 20-year-old passenger, explains that they arrived at the Place des Fêtes in Aube. He admits that they were afraid when they saw the police. He claims that he no longer touches drugs, but that he bought them for €280 for 100 grams to resell them during the party.

“There were people who asked me for it.” “How much did you want to get?” the president asks him. “I wanted to see how much it would bring me first and see later.”

He admits that he had reached an agreement with François, the other passenger. A certain Alain (1), aged 21, arrived afterwards.

“In the wrong place…”

“I found myself in the wrong place at the wrong time, but I took the opportunity to buy 50 grams which I intended to resell to buy clothes” explains Alain. He admits that he has been a user since he was 15 years old.

During the searches, a 12-gauge semi-automatic hunting rifle was discovered at François' home, which he declared having bought from a man he met in the street for €200. He talks about his military past and his pleasure of holding a weapon.

“You have to hit your wallet”

The public prosecutor recalls that the facts are characterized and recognized. He estimates a profit, on resale, of at least €3,000. Certainly, all three of them are unknown to the justice system, but “you have to hit the wallet”. He requested a misdemeanor fine of €1,600 and a six-month suspended prison sentence, confiscation of the sums seized in addition to a ban on possessing a weapon against François.

Suspended sentences and fines

All three will be sentenced to a suspended prison sentence of four months in addition to a fine of 1 000 € dont 800 € suspended. François, as an additional sentence, is sentenced to a ban on possessing or carrying a weapon for two years. The court grants his request for exclusion from registration in bulletin no. 2 of the criminal record and orders the confiscation of the seized sums.
