Drama in Aude: there were 7 in the car… an 18-year-old woman lost her life in a road accident

Last Sunday, April 7, it was around 4:30 a.m. that the emergency services were alerted, when a traffic accident had just taken place on the D 103 between Saint-Papoul and Castelnaudary. Regarding the circumstances of the tragedy, we learn that the defendant was returning from a drunken evening at the wheel of his father's Citroën C5, when he lost control of the vehicle where there were seven of them crammed together without seat belts. There was even a person sitting in the trunk. After hitting a bedrock on the road, the C5 took off and rolled several times over nearly seventy meters. Speed is no stranger to this.

We were planning to leave as a group of five, but in the rush we didn't think about the risks.

Three of the seven occupants of the car will then be ejected. Kyara, sitting in the back on the knees of her friend Clémence, died instantly. Clémence will, for her part, be seriously injured. He will be issued 45 days of ITT. The five other occupants of the car will also be injured, but to a lesser degree with ITTs ranging from 1, 2, 7, 10… and 21 days for the defendant. The blood test on him will reveal an alcohol level of 1.33 g per liter of blood, as well as a recent use of cannabis. He had had his driving license for two months.

In court, he has difficulty expressing himself, sometimes with long silences: “We were supposed to sleep there in the Saint-Papoul village hall, but the evening went wrong… Afterwards, I felt able to drive”he said. Why did seven people get into the car?We were planning to leave as a group of five, but in the rush we didn't think about the risks.” Behind that, the defendant says he does not remember the accident. His theory is that he fell asleep at the wheel: “I woke up in the grass. I heard screams, tears… I learned of Kyara’s death two days later, at the hospital”.

We are not dealing with a simple clumsy error…

In the interests of Kyara's parents, Me Agnès Dufétel-Cordier (Toulouse bar) returned to this drama, to which is added “the anger of my clients who were not directly informed of the death of their daughter. This is how we treat grieving parents!” What can we say about the defendant? “whose custody measure has been postponed several times. We are not dealing with a simple mistake of clumsiness, but today, we are faced with someone mute who presents himself as a fragile little thing. With answers extracted by forceps He does not assume his responsibilities…” In support of Clémence, present at the hearing and still in shock, Me Sabrina Vidal (Toulouse bar) insisted that “It's a miracle that there are no other deaths. Today, my client's life revolves around care and follow-ups. We are still two or three years away from her consolidation”.

We don't send this kind of profile to prison…

For the public prosecutor, its representative did not hide her difficulty in “finding the words to speak of such horror… The guilt of the defendant, who faces ten years in prison, is not up for debate. He is a young person in great suffering, who has difficulty defining himself as guilty…” The sentence of three years in prison, two of which were suspended on probation for a period of two years, was thus requested. In defense, Me Stéphane Cabée (Carcassonne bar) carried Marceau’s voice “who, at his age, thinks that this only happens to other people. But the one who is going to get behind the wheel is him! Everyone is going to get in this car, because we are celebrating… My client is traumatized for life, just like his brother He's not a little boss from the suburbs, he's never had anything to do with the law. We don't send this kind of profile to prison, even if I understand very well that it is. 'is complicated for everyone…” At the end of its deliberations, the court followed the requisitions of the prosecution, with an arrangement in the form of home detention under electronic surveillance (DDSE) for the firm part. The cancellation of the defendant's license was ordered, with the prohibition that he retake it within three years.

“When we heard the news, everything stopped for us!”, testify Kyara’s parents

What could be more terrible for parents than losing their child in circumstances as dramatic as these… This Wednesday morning, it was first of all Kyara's dad who took the stand to denounce “the absence of support from the gendarmerie” in the painful ordeal that was his and his partner's, following the death of their eldest daughter. This father speaks in particular of “mistreatment, because we spent a day without knowing where our daughter was. We found out that she was dead from the village mayor, more than three hours after the accident… Before, we experienced small pleasures with our two daughters wonderful, who were our two prides. Only one left! Kyara had a job and was going to get her license. We lived simply but we were happy. When we heard the news, everything stopped for us. Since then, nothing has happened. has no meaning or taste. Our life is ruined. He only has the face of an angel but he is not excusable..

Devastated, Kyara's mother explains that “the world has collapsed under its feet since April 7, 2024. We expect justice to protect us and other families. From April 7 until the end of June 2024, the one who killed our daughter stayed with his driver's license and continued to go out in the evenings and drink alcohol as if nothing had happened… Today, it's too late for forgiveness. error is irreversible and irreparable. Also, we hope that our daughter's life will not be reduced to a sum of money. We want prison! During their testimony, Kyara's parents were moved by the silence of the defendant and his parents after the accident.
