A 32-year-old man was tried in immediate appearance on Monday, July 1, 2024, by the judicial court of Orléans (Loiret). He had to explain the facts that occurred on May 19, 2024. Taking care of his one-year-old child alone, he had taken him to the pediatric emergency room, where shaken baby syndrome was diagnosed, reports The Republic of the Center .
The child was found to have a skull fracture, rib fractures and a hemorrhage in his eye. In court, the man eventually admitted that he had shaken his son. However, he denied having done so. “thrown against a hard surface”as he was accused of doing.
Withdrawal of parental authority
The child had already been taken to the pediatric emergency room at the end of 2023. The father had explained that he was “came across a toy”. But his injuries were inconsistent with the father’s explanation, according to an expert.
The defendant was ultimately found guilty of the latter facts and sentenced to three years in prison, two of which were to be served with continued detention. He was also sentenced to one year in prison, suspended with probation for two years, including an obligation to provide treatment and to compensate the victim, with whom he is prohibited from having any contact.
His parental authority was taken away from him. He will have to pay €7,000 to his son and €1,500 to his partner in moral damages.
