At 65, Thierry Mosca, candidate of the National Rally in the 2nd constituency of Jura, was placed under the guardianship of the Departmental Union of Family Associations. His candidacy was nevertheless validated by the prefecture.

In the event of a victory, Thierry Mosca’s election could well be directly called into question. The National Rally candidate in the 2nd constituency of Jura qualified for the second round of the legislative elections… even though his placement under guardianship makes him ineligible, AFP learned on Monday, July 1 from concordant sources. Thierry Mosca, 65, was placed under the guardianship of the Departmental Union of Family Associations (Udaf) of Jura in November 2023, indicated a judicial source, confirming information published by the daily Progress.

A procedure targeting him for “hidden work” was also closed without further action at the beginning of June due to a “mentally impaired”it was added. This did not prevent the RN candidate from finishing on Sunday in second place in the first round of the legislative elections in the 2nd constituency of Jura with 32.76% of the votes, behind the outgoing MP (LR) Marie-Christine Dalloz (38.59%) and ahead of the communist candidate Evelyne Ternant (24.75%). The latter announced her withdrawal in the second round to block the RN.

“His candidacy was duly registered”the Jura prefecture services told AFP. “People under guardianship or curatorship are ineligible according to article LO129, but article LO128 provides that only people declared ineligible by the administrative judge or by the Council of State can apply.”it is specified. Thierry Mosca is not concerned by this last scenario, he can therefore run, but his possible election could be challenged in court and invalidated after the vote.

The documents provided at the time of filing applications do not allow the prefectures to know if a person is under guardianship, the prefecture emphasizes. On the other hand, in the event of election, a birth certificate is then requested, where this mention may appear. A guardianship measure is decided when there is an alteration of a person’s mental faculties, preventing them from looking after their own interests. Contacted by the AFP, Thierry Mosca and the RN did not respond.
