Several associations have filed an appeal with the Council of State against the A69 motorway concession contract. They believe that its duration is “abnormally long”.

New legal battle against the A69 motorway between Toulouse and Castres. A appeal was filed with the Council of State by lawyer Christophe Lèguevaques, at the request of Agir pour l’Environnement, Attac Tarn and the association Les Vallons, this Wednesday, June 26, to cancel the concession contract awarded to Atosca. A request for interim relief to suspend the work was also made.

“In the application, we have demonstrated thatIt’s urgentparticularly because of the work that is progressing and because things need to be clarified as soon as possible. But this remains at the discretion of the interim relief judge of the Council of State,” specifies Christophe Lèguevaques. He therefore hopes for a hearing date “before July 10.” “Otherwise, it is considered that there is no urgency,” indicates the lawyer.

An “abnormally long” concession contract duration

In their appeal, the associations point to the duration of the concession contract. For them, it is “abnormally long”. “We have a duration of more than 40 years which is normally the maximum,” indicates Christophe Lèguevaques. Indeed, the contract is for 55 years “to meet the requirements of lenders according to the Transport Regulatory Authority,” the lawyer reports.

” This is unheard of ! », he exclaims before specifying that the duration of the concession is usually set “between 25 and 40 years”. Christophe Lèguevaques, who believes that the A69 is “a crazy project”, hopes that “the Council of State will see that there is a clear violation of regulationsthat the concession contract is null and void and that work must be stopped immediately.”
