A man opened fire on a hooded and armed burglar, who had entered his home in Montfaucon (), on Saturday. The public prosecutor of Nîmes, Cécile Gensac, announced in a press release this Monday that self-defense was accepted at this stage. The farmer who fired the shot was released without charge at the end of his police custody, specifies the magistrate.

It was around 8 p.m. when the Roquemaure gendarmes were “required to intervene at the scene of a burglary involving gunshots in a property in Montfaucon”. “The owner of the place explained that they were having dinner with his wife when he found himself face to face with a hooded and armed person”details the prosecutor. “Unable to dissuade her, he grabbed a weapon and fired it before taking shelter with his wife”.

The police quickly arrived on the scene, as did the firefighters, who took care of the burglar, who was seriously injured in the arm, without his life threatening. “An investigation was opened into the counts of attempted theft with a weapon on one side, and for the violence with a weapon which resulted in serious injuries to the burglar. It was conducted by the gendarmes of the gendarmerie company of Bagnols-sur-Cèze .”continues Cécile Gensac.

“While the burglar was hospitalized and has not yet been able to be questioned, the owner of the premises was questioned under the legal regime of police custody”confirms the prosecutor.
“The first investigations carried out quickly in order to determine the exact course of the facts via the hearings of the victims, the witnesses, and the accused, but also several technical investigations, led to a re-establishment of the course of the events on Sunday after -noon in the presence of the public prosecutor, who allowed at this stage to retain the conditions of self-defense as provided for by the penal code”.

The suspect is already known to the courts

“Investigations will continue into the facts and the charge of attempted robbery with a weapon and by an organized gang, with a view to questioning the man arrested, and identifying any other person involved”we specify. The burglar apparently acted with an accomplice who is on the run.

The 51-year-old suspect, “implicated for the acts of attempted aggravated theft”East “already known to the justice services for acts of various nature (drugs, theft and traffic crime)”underlines the public prosecutor.
