Tuesday April 16, as usual, Camille went to the Champs-sur-Marne nautical center after her day of work. Around 8:30 p.m., after her swimming session, she locked herself in her cabin to dry off and change. With her back to the door, she heard a slight noise that prompted her to turn around. While she was naked she got the unpleasant surprise of seeing a hand appear holding a cell phone. She quickly wrapped herself in a large towel and pushed the door violently. Seeing a young Asian man running away, she chased him screaming.
Stopped in his tracks by a swimmer, Jonathan found himself face to face with Camille. He had no choice but to show her his phone and delete the photos of her. He tried to take advantage of the confusion to escape, but the arrival of five other people dissuaded him.
The Torcy police intervened. They arrested Jonathan and took him into custody based on Camille's statements. which was then confirmed by a complaint.
Not the first time
During his detention, Jonathan provided an explanation for his behavior: “ an addiction to sex and voyeurism born following a romantic breakup very difficult which occurred 18 months earlier. » He admitted the facts and confessed have already indulged in this practice in the toilets of restaurants, in the cabins of another swimming pool, in the fitting rooms of some stores… He claimed to keep the photos for only a few days and then make them disappear. An assertion immediately denied by the exploitation of his phone which revealed photos and videos of naked women, six months old. But impossible to identify the victims.
The search of his home and the check of his computer did not provide any additional information.
“I didn't think the victims could be hurt.”
Monday October 7, Jonathan appeared at the criminal hearing chaired by a single judge. After listening to the summary of the case and confirming that he recognized the facts, Jonathan declared: “at the time, I didn't think the victims could be injured. » An astonishing sentence which immediately made the magistrate react: “if the person had been a minor, you would be before a different composition of the court. »
Jonathan returned to the reasons for his addiction to voyeurism. “After the separation, I lost confidence in myself. I felt like I had been betrayed. I was afraid of forming a new relationship so I looked for a way to compensate for my lack of affection. » Not convinced at all by the defendant's explanations, the judge intervened once again: “I was left. I was betrayed. I was in need of affection. What does this have to do with voyeurism? » To respond to this remark, Jonathan added: “when I have an impulse, I seize an opportunity, but I don't scout. I look at the feet to see if it is of age. » According to him, four sessions with the psychologist and intensive practice of sport would have been enough to cure him of any sudden desire.
Eight months suspended prison sentence
Invited to speak, Camille gave a description of the scene before exclaiming: “ Before, the swimming pool was a pleasure for me! Now I don't go there anymore. Everywhere I go, I'm on the alert! My only expectation is that he won't be able to do it again! »
His lawyer added: “Monsieur is a predator, but thanks to her, his actions are over. » Before issuing a quantified request for compensation, he regretted the absence of psychiatric expertise for the victims while it is obligatory for the defendants.
The public prosecutor reported that an analysis of the computer memory of Jonathan's computer was still in progress. Citing fear of a possible repeat offense, she requested a six-month suspended prison sentence accompanied by an obligation to provide psychological care.
The defense attorney did not attempt to justify Jonathan's actions as immaturity or irresponsibility. On the contrary, he began by saluting the courage of the victim before considering that the arrest of his client was “an evil for a good”, thus putting an end to a “serious and unpleasant” offense. »
The judge found Jonathan guilty and gave him eight months suspended sentence. He must respect the ban on contacting the victim and attending the nautical center for three years. He will also have to pay Camille €3,500 for moral damage and €1,200 for lawyer's fees.
