This Sunday, November 3, the CGT and South unions of the Toulouse University Hospital announced that the intern whose assignment was suspended by the ARS on October 24 has filed an appeal.
New development in the case of the intern convicted of sexual assault, who was to do his internship in the radiology department of the Carcassonne hospital center, attached to the Toulouse University Hospital, from this Monday, November 4.
On October 24, the Regional Health Agency announced its decision to suspend the assignment of the 26-year-old intern in order to “allow the entire hospital community of these establishments to calmly carry out their mission of public hospital service, and also allow the criminal and disciplinary authorities to investigate this case in a climate more conducive to the smooth running of these procedures. The medical student is in fact the subject of a disciplinary procedure by the Faculty of Medicine of Tours, where he was registered at the time of the acts for which he was convicted. At the same time, he must be tried again for these sexual assaults, the prosecution having appealed the sentence of 5 years in prison with a probationary suspension of 3 years, pronounced on March 19, 2024.
But this Sunday, November 3, the CGT and Sud unions of the Toulouse University Hospital announced that Nicolas W.'s lawyer had filed an interim appeal against the ARS decision before the Toulouse administrative court, the hearing of which would be scheduled for on November 21. “We deplore in this appeal the lack of respect for the expression of the vast majority of professionals from Carcassonne and Toulouse but also from the entire country, and the lack of respect for all the victims of this individual”indicate the union authorities.
The CGT and Sud du CHU had planned, before the announcement of the intern's suspension, a demonstration this Monday, November 4 at 8 a.m. to protest against his assignment. This demonstration was therefore finally canceled, but thanks to this appeal, a new mobilization is scheduled before the administrative court of Toulouse on the day of the hearing. “How can we defend that these acts did not take place in the hospital setting, that they would not have consequences on medical practice? These were students from his class. And even so, a public hospital official, doctor or not, must be of total integrity“, raise the unions. “But the good news is the reaction, even slow, from the administration proving that #MeTooHospital has started well and will not stop there. There is profound work to be done for the prevention and condemnation of sexual and gender-based violence in hospitals This episode highlights how far we have to go.”.
As a reminder, the announcement of the assignment to the Toulouse University Hospital of this intern convicted of sexual assault on several of his classmates, ignited the powder last October. The union organizations of the Toulouse University Hospital, then those of the Carcassonne hospital center, had threatened to exercise their right of withdrawal.
