Presented for immediate appearance on September 23, he requested time to prepare his defense. This 57-year-old man was tried last Thursday for several offenses of attacks on property and people. He was sentenced to five years in prison, including four years.

They lived together for 28 years and had a daughter who is now 11 years old. He is craftsman on Île d’Yeu (Vendée). Five years ago, the couple separated. A year later his ex-partner starts a new life with another man. A situation that does not pass for the ex-husband, he becomes more and more alcoholic and descends into delinquency. For see his daughter, he has visiting rights, one to two hours per week, in a neutral place and in the presence of a third party. This third party is none other than the new companion. Which doesn't help the already particularly stormy relationship.

“I am being prevented from seeing my daughter”

He keeps repeating it on the stand: “They are preventing me from seeing my daughter, they are turning her against me”. And yet, in front of family court judge the mother had not requested a visitation ban “so as not to cut a father’s ties with his child”.

“My life is hell”

But the situation is getting tense, he is drinking more and more. So much so that he manages to scare his daughter. She doesn’t want to see him anymore, “She’s afraid of him, especially when he’s been drinking,” says the mother. She continues to the investigators: “ My life is hell, yet I fight. I know it, he's going to kill me. My death is announced.” She also reveals: “My daughter wrote to the judge without my knowledge to say that she no longer wanted to see her father.”

Hundreds of messages

On May 3, 2024, the man was arrested by the police, he had just fallen from a two-wheeler which had been reported stolen. He has a blood alcohol content of 1.60 grams. He denies the theft of the machine.

His journey of delinquency will continue. He believes that his ex-partner, his daughter and his new companion are “responsible” for his physical and moral decline.”

“I’m going to put a bullet between your eyes.”

From June to September, hundreds of messages were sent to the family. “Daily harassment, day and night, with repeated death threats,” said the mother. Eloquent words, like: “I’m going to put a bullet between your eyes.”

Until two bikes were stolen from the former shared residence, “it was at home, in my garage,” he says, not having really understood that he had not been at home for several years. Even more, on September 21, 2024, he returns to the house, enters without being invited and hits the new companion.

Since then, the family has gone to live in at the companion's home.

“It is harmful to these people and to society”

For the public prosecutor Eric Bret, “this man is a pervert who delights in the suffering of this couple and their daughter. It is harmful to these people and to society. The longer he is imprisoned, the longer the civil parties and society will be protected.” Six years in prison and numerous bans are required.

“He needs help”

For Me Jean-Brieuc Davy, who defends the accused, “he has worked a lot for twenty years, he does not live off society. Today he is a man in distress. There is a blockage at home, he has difficulty admitting that the residence on the island of Yeu is no longer his home. He needs help, a long incarceration is not the solution.”

After deliberating, the court sentenced the defendant to five years in prison, including one year suspended for two years, with an obligation to provide care and work. In addition, he is banned from contacting the entire family and banned from staying in Vendée and Gard for a period of 10 years. He is also banned from possessing a weapon for five years. He was returned to a remand center following the hearing.
