The Administrative Court of Guadeloupe has just pronounced the termination with immediate effect of the agreement for the occupation of the public domain concluded by the municipality of Saint-François with the company Maxo Location FWI for the operation of the bar-restaurant and the entertainment of the Saint-François golf club house.
It is the administrative aspect of this affair started in August 2022 which has just been concluded. Following a call for projects, the city of Saint-François awarded the operation of a golf catering structure to the company Maxo Location FWI, although less well rated than the company Caribbean Street Foot and its representative Aurélien Acina. In February 2023, the latter then began proceedings, on the criminal level, for illegal taking of interest and favoritism against Bernard Pancrel, mayor of Saint-François and on the administrative level.
Seized by this ousted competitor, the administrative court of Guadeloupe considered that the municipality had modified the criteria for selecting offers during the award procedure and that this defect, constituting an attack on the principles of transparency and equality of candidates, was likely to result in the immediate termination of the agreement. Now for the criminal aspect of the case.
It’s a first victory. Indeed, now it’s time for criminal proceedings.

Bernard Pancrel is summoned on June 11 before the Pointe-à-Pitre criminal court. The mayor of Saint-François must answer for alleged acts of favoritism and forgery and use of false administrative documents.
