Barely a month spent at the head of State, the President of the Republic Bassirou Diomaye Diakhar Faye is increasingly distinguished through certain acts which seem to attest to his determination to implement as best he can his agenda of systemic rupture promised to the Senegalese during the electoral campaign. Indeed, notwithstanding the false note noted in the appointment of certain directors general outside the prior call for tender procedure in accordance with his commitment reaffirmed during the second Council of Ministers of April 17, the current head of state is already illustrated by several quite innovative acts in its governance. IN Senegal, the question of voluntary resignation of mayors and deputies is addressed by article 133 of Law No. 2013-10 of December 28, 2013 relating to the General Code of Territorial Communities. In its first paragraph, this article specifies that “Resignations of mayors and deputies are addressed to the Minister responsible for Local Authorities by registered letter with acknowledgment of receipt”. Going further, the second paragraph states that these resignations “are definitive from their acceptance by the Minister responsible for local authorities or one month after the sending of a new registered letter”. And the third paragraph which deals with the requirement of continuity of service states that “Until the installation of their successors, resigning mayors and deputies continue to exercise their functions – with the exception of those provided for in the provisions of articles 99, 121, 135.
