The administrative court of Lille annulled the expulsion order of Sana, a 24-year-old mother, to Algeria. The former prefect of the North believed that this mother returning from Syria constituted “a threat”, a version contradicted by the lawyer of the 24-year-old young woman.

Georges-François Leclerc had made it a priority. The former prefect of the North signed an order on October 10 to expel the 24-year-old mother to Algeria, a country where she had never set foot, affirming that “the presence of Sana on French territory (constituted) a serious and persistent threat to public order.”

However, the judges of the commission for the expulsion of foreigners ruled against the expulsion of the young woman, at the end of a hearing which we attended and which we reported on. A simply advisory opinion and which the Northern prefect had decided not to follow, provoking the anger of Sana’s lawyer.

The expulsion order was initially suspended last October by the administrative court, but justice has just confirmed the cancellation of the prefect’s expulsion order on May 3, 2024, as indicated by our colleagues in Le Monde. Here are the reasons.

In 2014, Sana, originally from Roubais, was barely 15 years old. Her mother then took her by force with her brothers and sisters to Syria, to the territory then occupied by the Islamic State. After five years spent in territories controlled by Daesh and four in camps in northern Syria with her two children, the young woman was repatriated to France in January 2023.

Upon her return to the North, Sana was not indicted, nor placed under the status of assisted witness, however, the administrative court recalls in its judgment.

If she did not expressly condemn the terrorist organization with which she lived for several years, she has, on numerous occasions, distanced herself and expressed her hostility towards her original environment and this period. of his life.

The applicant, whose “no evidence in the file” does not prove that she fought in the jihadist ranks nor exercised responsibilities, according to the court, further demonstrated “his desire for social and professional integration”.

Reached by telephone, Marie Dosé, Sana’s lawyer, welcomes this court decision. “I am obviously extremely reassured and happy.” A relief, mixed with a touch of bitterness. “I say to myself, what a waste of time, energy and what a waste. It has been almost a year since Sana and her two little girls were plunged into insecurity and a new form of violence which was completely illegitimate and which only served ‘to do more harm. That’s what saddens me.

A question now: Sana, an Algerian national in an irregular situation in France because her mother refused to apply for French nationality for her as a teenager, will she be able to obtain a residence permit?
