A notable escapade when the former President of the Republic had been definitively sentenced by the Court of Cassation to one year of “home detention under electronic surveillance”. More precisely, the judgment rendered on December 18, 2024 in the context of the wiretapping affair sentenced Nicolas Sarkozy to two years of suspended prison time and one year, therefore, under an electronic bracelet.

A non-immediate procedure

The presence of the former president on the Indian Ocean archipelago can be explained by the non-immediate nature of the installation of the bracelet after the verdict was pronounced. As explained 20 Minutesthe general prosecutor’s office has one month to refer the matter to the sentence enforcement judge. Then, the said judge has four months after the verdict is pronounced to define the terms of the sentence.

What about this procedure? It “follows its course”, the Paris prosecutor’s office told our colleagues. But in a still plausible scenario, the former head of state could well escape the electronic bracelet thanks to his age. Indeed, Nicolas Sarkozy celebrates his 70th birthday on January 28, and will be able, according to article 729 of the Code of Criminal Procedure, to request conditional release.

In any case, the former president will have to appear in another case from January 6, around suspicions of Libyan financing of his 2007 presidential campaign.
