the associated promoter sentenced again on appeal

The Court of Appeal confirmed on Thursday December 19 the sanction targeting the promoter Dominique Dutreix, associate of Charlotte Gainsbourg ordered to repay nearly one million euros in the case of Maison Gainsbourg, in debt and placed in receivership. . Dominique Dutreix, 50% co-partner with the artist’s daughter within the operating company of Serge Gainsbourg’s private mansion and its annexes (SEHPSGA), was ordered to reimburse 988,383 euros, including 505,683 euros “as a current account advance”in a judgment consulted by AFP.

The Paris Court of Appeal confirmed the order of the Paris Commercial Court made on March 28, except for the amount of this last sum, which was divided by approximately two. This subtraction comes from the fact that part of the debt was processed between the first instance and the appeal. Reimbursement “does not face any serious dispute” and must be completed within three days under penalty of penalty. “1,000 euros per day late”according to the judgment. “Ms. Charlotte Gainsbourg was kept away from all financial flows affecting the SEHPSGA and the management actions of Mr. Dutreix”underlined the court of appeal.

“There is no mistake: it is wrongful behavior”

The septuagenarian promoter has announced that he will appeal to the Court of Cassation, although this appeal is not suspensive. It also counts “seize the Paris commercial court to have his status as co-obligated party recognized in the current legal settlement”declared to AFP the 2017 cabinet, which advises him in this procedure. “These steps aim to demonstrate that Dominique Dutreix acted, in all circumstances, in accordance with the law”added this firm. For his part, Me Jean Aittouares, Ms. Gainsbourg’s lawyer, told AFP that this decision demonstrated “the great failure” of this associate. “There is no mistake: it is wrongful behavior”he said.

With an initial unpaid debt of around 1.6 million euros and irregular management, Maison Gainsbourg had to be placed in receivership for cessation of payments on September 18, two days before blowing out its first candle. Currently in the observation phase, it has until March to get things back on track by paying off its debt. Behind this financial slump, the rue de Verneuil project (in the center of the capital) has never ceased to attract the public, whether it is the mythical lair of Serge Gainsbourg at 5 bis or the museum which traces the artist’s work with iconic songs like I love you… me neither.
