Justice prevails! The Nuremberg Code is reinstated! Let us rejoice, because Big Pharma has just taken its first knee!
According to some Internet users, Robert F Kennedy Jr. (RFK), future Secretary of Health and Social Services in the Donald Trump government, has won a historic trial linked to the damage caused by messenger RNA vaccines.
“A victory for truth and justice!!! “, can we read on Facebook. “This Supreme Court decision is a historic moment. It represents the triumph of truth over deception, justice over corruption, and humanity over greed. Robert F. Kennedy Jr. showed us that courage and perseverance can change the world”, some Internet users rejoice.
As proof, they point to press articles which claim that the United States Supreme Court ruled in favor of Robert F. Kennedy Jr., confirming that the damage caused by mRNA gene therapies against Covid – 19 are irreparable.
The articles shared also argue that this decision represents much more than a simple victory and “announces a new era of transparency and justice”. She would prove that “the voices of the hurt and silenced can no longer be ignored. » It’s beautiful… but it’s also false.
Fake articles flourishing since 2021
A veritable sea serpent of RFK’s legal career, these falsehoods keep coming back every year. In 2021, some posts on social networks were wrongly forwarded that the United States Supreme Court had ruled that coronavirus vaccines were unsafe and had, at RFK’s request, “cancelled universal vaccination”.
Rebelote, in 2022, new false information indicates that the former lawyer specializing in environmental law had won a case before the Supreme Court of the United States against “all pharmaceutical lobbyists”. The Court would have ruled that messenger RNA vaccines against Covid -19 caused harm “irreparable”. It is this decision which returns in 2024shared en masse on social networks.
If the nephew of John Fitzgerald Kennedy to good declared having participated more than thirty trials concerning the safety of vaccines, these are still ongoing. Indeed, none of these has been decided by the Supreme Court.
In an interview with theAssociated Press in 2021, Robert F. Kennedy Jr., confirmed that these articles and quotes attributed to him were false: “The article about the Supreme Court is misinformation. The quote is fabricated. Clearly someone made it up and is promoting it, because the same quote keeps coming up, even though I repeatedly deny it. The same article keeps reappearing. »
L’Associated Press also specifies on this subject that these misleading publications wrongly identified RFK as “Senator Kennedy”although it was his father who was a senator before being assassinated in 1968. RFK is not a senator, but a lawyer.
Error 404 Jurisprudence not found
According to Reutersthis false legal victory could be inspired by a real case: that of the dispute between the Informed Consent Action Network (ICAN), an American anti-vaccine organization and the American Department of Health and Human Services before the southern district court of new york.
-In this case, RFK represented ICAN, and initiated the lawsuit to force the department to provide Congress with copies of its biennial vaccine safety reports or admit that they never existed. The case, however, was settled in 2018 without reaching the U.S. Supreme Court and without involving a decision to overturn universal vaccination or deem vaccines unsafe.
By doing a quick search on the case law of the Supreme Court of the United Statesno results confirm that the Court has ruled that the harm caused by coronavirus vaccines is “irreparable”. And this, whether in the year 2022 or 2024.
However, even if the US Supreme Court had issued a ruling on the safety of messenger RNA vaccines against the coronavirus, it would not have ruled on them. Such a decision would not be consistent with the role of the country’s court of last resort.
Indeed, Margaret Foster Riley, professor of law and public health sciences at the University of Virginia, in an interview conducted by USA Today, specifies that “the Supreme Court rules on the application of the law – regulations, laws and the Constitution – it is not responsible for judging the facts. It can apply the facts to the law, but it does not rule on them.”
Asked about the veracity of these online publications, the teacher is formal : “The Supreme Court did not rule that Covid-19 vaccines caused irreparable harm.”
On the contrary, Robert F. Kennedy Jr., rather than “win a historic trial” as Internet users say, sees his trials rejected by the United States Supreme Court. The court, in fact, rejected the appeal of two vaccine-related cases brought by the Children’s Health Defense, anti-vaccine association founded by Kennedy.
A proliferation of misinformation due to RFK’s person
The persistence of this misinformation is due to the controversial person to whom it is attached. In fact, the man is a figure of anti-vaccines and covid skeptics, and has become known for his divisive statements.
RFK had, for example, argued that « autism comes from vaccines« , that Covid-19 is a « ethnically prepared biological weapon aimed at attacking Caucasians and blacks”, or he had again compared the restrictions during the Covid-19 crisis to the living conditions of Ann Frank.
