Corsican businessman Paul Canarelli contested having monopolized the house of an artist, landlocked on the land of his luxurious estate, in Corsica-du-Sud: the Court of Cassation rejected his appeal, confirming his sentence of one one year suspended prison sentence and a fine of 40,000 euros.

“After examining both the admissibility of the appeal and the procedural documents, the Court of Cassation notes that there is, in this case, no means likely to allow the appeal to be admitted,” the Court concluded on Wednesday. of cassation in its judgment consulted Thursday by AFP.

This decision makes final the sentence handed down on appeal in in 2023 to one year of suspended imprisonment, a fine of 40,000 euros and confiscation, for trespassing, damage and theft.

The owner of the Murtoli estate, popular with billionaires and personalities like Leonardo Di Caprio and Nicolas Sarkozy, was found guilty of trespassing for having changed the locks of the 17th century Genoese tower, purchased by his accuser, Anne de Carbuccia, in 2001 and long considered one of the most beautiful residences in Corsica.

Mr. Canarelli, also targeted in several other legal proceedings, was also found guilty of theft, for having emptied the house of the artist’s personal effects, and of damage, for having carried out work there which distorted the property.

At the heart of this long-running legal drama is the famous fort located at the end of the Murtoli estate, an agricultural and hunting reserve dotted with luxury sheepfolds.

The tower, seen in advertisements and magazines, was purchased in 2001 from the previous owner, Paul d’Ortoli, by Mrs. de Carbuccia, wife of Italian billionaire Alberto Tazartes.

But in June 2005, Mr. Canarelli, who until then thought that the artist was only a tenant, invoked an oral commercial lease with Paul d’Ortoli: he contested the sale and asserted his right to exploit the residence by renting it. to third parties.

In 2006, he had the locks changed. Anne de Carbuccia will have no access to it until, in 2009, the courts confirm her rights.

The court of appeal also ordered Mr. Canarelli to pay 80,000 euros in damages and 20,000 euros to reimburse his legal costs.

In this case, Mr. Canarelli is the subject of a direct summons before the criminal court for fraudulent insolvency organization filed by Ms. Carbuccia’s lawyer who is still awaiting payment of damages. A hearing is scheduled for Tuesday.

Thursday, in another case, at the trial of the escape of Jean-Luc Germani, a figure of banditry in Corsica, Paul Canarelli was sentenced to one year of suspended imprisonment and a fine of 10,000 euros, confirmed to the AFP a judicial source.

Tried for criminal concealment, which he denies, Paul Canarelli was found guilty of having helped, during his escape in 2014, Jean-Luc Germani, brother-in-law and designated heir of Richard Casanova, one of the barons murdered from one of the most influential criminal gangs in Corsica, by hosting him in his luxurious hotel estate.

Arrested on November 27, 2014 in possession of a false identity card and two false passports and while he had been wanted for three years, Mr. Germani, absent at his trial, was sentenced to three years in prison.
