The Ministry of Justice is ensuring the implementation of a series of legal measures to support commercial disputes, particularly with regard to the issue of deadlines, the Minister of Justice said on Monday in the House of Representatives. Justice, Abdellatif Ouahbi.
In a response, read on his behalf by the Minister Delegate in charge of Relations with Parliament, Government Spokesperson, Mustapha Baitas, to a question around “the current legal system and deadlines in commercial disputes and their compliance after the entry into force of the Investment Charter”, Mr. Ouahbi reviewed a series of measures taken by his department, including the bringing of commercial justice closer to litigants, the development of a bill relating to the procedure civil law and the promulgation of Law 95-17 relating to conventional arbitration and mediation.
Regarding the bringing of commercial justice closer to litigants, the minister announced the creation of two commercial courts in the cities of Laâyoune and Dakhla, in accordance with Decree No. 2.22.62 of February 25, 2022, as well as the creation of 'a commercial court of first instance in Beni Mellal, two commercial courts of appeal in Agadir and Tangier, under decree no. 2.23.665, published on November 10, 2023.
Regarding the development of the bill relating to civil procedure, he stressed that this project attached great importance to the digitalization of judicial procedures, noting that its provisions provide for the establishment of an electronic platform for the management of legal proceedings in courts of first instance and courts of appeal, in order to save time in resolving problems related to notifications and the execution of judgments, in particular for commercial disputes which require rapid decisions within reasonable time limits.
Regarding Law 95-17 relating to conventional arbitration and mediation, Mr. Ouahbi noted that this legislative text aims to develop alternative methods of conflict resolution, such as mediation, arbitration and conciliation. , with a view to resolving investment-related disputes in a rapid, flexible and efficient manner, while preserving economic and commercial relations between the parties.
The provisions of this law encourage the resolution of disputes outside the traditional judicial framework, often marked by complex and slow procedures, he added.
