This is not yet another scam. German justice has just handed down a verdict that could set a precedent. It ruled that Meta, the parent company of Facebook, was responsible for the data leak exposed in 2021, which implies that it has a duty to compensate. Explanations.
Despite the implementation of certain measures, large companies are never safe from a hack leading to a data leak. This leads some users to attack the entity in question. In this case, it was a German Facebook user who filed a complaint following the data leak highlighted three years ago. After an initial complaint was rejected, the latter was echoed by the Federal Court of Justice. She returned a favorable verdict.
If the latter did not grant her request for 1,000 euros in compensation for “moral harm”, she nevertheless assessed it at 100 euros. She justified her decision by specifying, as reported by BFMTV, that “the simple loss of control of one’s own personal data following a violation of the GDPR constitutes “moral damage” which must be repaired”.
Of course, Meta appealed the decision to the Cologne Court of Appeal. The American company claims that this decision regarding damages “is not in line with recent judgments of the Court of Justice of the EU”. It is based on the fact that more than 6,000 similar requests have already been rejected by German courts.
This last decision will be particularly awaited. Indeed, if the Court of Appeal rules against Meta, the company owning Facebook could be obliged to compensate each user affected by the data leak, up to 100 euros per head. There are 533 million people who could therefore claim this compensation for moral damage.
