The group action against Stellantis takes shape in the context of defective airbags. The MyLeo platform will file a complaint against Stellantis and launch a collective action.

We cannot say that the MyLeo platform is the Stellantis group’s greatest friend, but it is in any case very concerned by the automobile group since it is currently leading two front actions. The first is obviously the PureTech engine affair which affects hundreds of thousands of cars across Europe and certain non-EU markets.

The second concerns the security aspect since MyLeo has communicated strongly recently to attract customers of Citroën, Opel and other Stellantis vehicles affected by the Takata airbag affair.. Registrations for the file were opened on June 6 and were to continue until September. But yesterday, during a public meeting held in Marseille, Me Lèguevaques announced that the legal action would finally start earlier than expected.

The lead lawyer in charge of the case confirmed that the number of registrations was sufficient to process the case in the short term: “we said that we would launch the procedure from 1000 registrations, but given the number of registrations, we will launch the procedure immediately“. The time that “all documents from the United States” are gathered, MyLeo will initiate proceedings against Stellantis starting July 10.

Me Lèguevaques adds: “if the prosecution does nothing by October, we will refer the matter to the senior investigating judge“. The challenge is to find a financial compensation solution for customers who are directly affected today by no longer being able to drive their vehicle. For the moment, Stellantis is unable to obtain courtesy vehicles for all world. The group asked its network to lend used cars for sale, but as the FNA pointed out, this practice is complex and generates major administrative constraints.

The Lyon/Clermont line

The lawyers also confirmed that there had been 4 deaths in mainland France, including two in the Pyrenees, and particularly one in a cold region of the Hautes Pyrénées last November. The famous “Lyon/Clermont Ferrand” line used by Stellantis for recalls therefore makes no sense according to the complainants. The automobile group had in fact explained that weather conditions (hot and humid region) could cause the airbags to be triggered.. In reality, according to the lawyers, this choice to cut France in two for recalls is not linked to any constraint of the local climate but rather to the fact that Stellantis would not be able to supply everyone with airbags and would encounter too many logistical problems (availability of loaner vehicles, saturated garages). The group therefore decided to compartmentalize the recalls by first favoring the South before moving on to the rest of France.
