Three days after finding little Santiago in a hotel in Amsterdam, the defense of Christina and Kevin, the infant’s parents, is being organized little by little.
Lawyers for both parents spoke on RTL on Monday. In particular, they shared their intention to challenge the notion of kidnapping. Indeed, in legal terms, the concept of kidnapping would not be applicable to Santiago’s case, as custody had still not been taken away from the parents at the time of the case. “On Monday October 21, Christina left the hospital with her child and it was only the next day that the prosecutor issued an order for temporary placement of the child,” explains Christina’s lawyer.
Parents could therefore see their sentence reduced from 30 years’ imprisonment to 7 years, if they are prosecuted for deprivation of care to a minor under 15 years old. “We will have to determine this deprivation of care and the consequences it had on this child who, I remind you, gained weight during this run,” emphasizes Kevin’s lawyer. “He was treated, changed, bottle-fed.”
The two lawyers also said they wanted to cooperate fully with the police and agreed to be handed over to France. A hearing will take place this Monday with the Amsterdam Attorney General.
