European justice prevents the banning of the term in

Indeed, the judges of the Court of Justice of the European Union handed down their decision: “In the absence of adopting a legal name, a Member State cannot prohibit the use of terms traditionally associated with products of animal origin to designate a product containing vegetable proteins. »ALSO READ What if being vegetarian was in your genes?

In the press release, the Court notes that in the absence of a legal name the national authority will be able to pursue operators if “the specific terms of the sale or promotion of a foodstuff mislead the consumer”. “It is up to the national court to resolve the case in accordance with the Court’s decision,” the statement concluded.

Already suspended by the Council of State

As a reminder, several French associations had filed legal action in July 2023 after the State had signed a decree, in June 2022, which prohibited the use of the terms “steak” or “ham” to designate substitutes based on vegetable proteins.

The ban was requested by animal industry professionals, who believed that these names could be misleading for consumers. A similar decree promulgated in February 2024 was suspended by the Council of State, awaiting the decision of the European Court. The high court, “seriously” doubting the legality of the ban, added that this decree would cause “serious and immediate harm to the interests of manufacturers selling exclusively this type of product”.
