The King of Morocco, Mohammed VI, presided today at the Royal Palace of Casablanca, a working session dedicated to the issue of the revision of the Family Code.
This session comes after the Authority responsible for revising the Family Code presented, at the end of its mission within the allotted time, a report containing more than 100 proposed amendments, and subsequently the monarch contacted the High Council of Ulema in regarding some proposals relating to religious texts on which the Council has issued a legal opinion.
It also intervenes after the King has carried out the necessary arbitrations on the issues on which the Authority has issued multiple opinions or on those whose revision has required recourse to the Sharia opinion, whose real arbitrations have given priority to choices that meet the parameters and to the purposes defined in the Royal Letter addressed to the Head of Government, as well as those established by the rules governing the Authority's action, headed by the standard of “Do not prohibit what is permitted, nor authorize what is prohibited”.
The Family Code falls within the scope of the Royal will which aimed to strengthen and consolidate the family unit as a foundation
fundamental for Moroccan society. It is also the continuation of the 2004 reform, which marked an important turning point in issues relating to women's rights and the promotion of their condition, and highlighted the singularity of the Moroccan model at a regional and international level.
Through this Moudawana 2.0, the Sovereign once again traces the path, responding to contemporary challenges while remaining faithful to the principles of Islam and the specificities of the Moroccan family, in
respect for the principles of equality, justice and solidarity.
This work session took place in the presence of Prime Minister Aziz Akhannouch, who will have the task of presenting the bill relating to the revision of the Family Code to Parliament. In addition to the Head of Government, this work session was also attended by the Minister of Justice, the Minister of Habous and Islamic Affairs in his capacity as member of the Higher Council of the Ulema, responsible for presenting the conclusions of the opinion of the Council on certain proposals
relating to religious texts.
This work session represents the culmination of the expanded consultation and debate process that the King wanted to adopt on the issue of the revision of the Family Code, the process of which was carried out in gradual and multiple listening phases
The work session also takes place after the King has carried out the necessary arbitrations to aim for the good of the Moroccan family, in compliance with the rules and intended purposes.
This work session was the opportunity for the Minister of Justice to present himself before the King with the approach and methodology that governed the work of the Authority, in particular in the listening and hearing phase, as well as for the proposals submitted to the monarch. For his part, the Minister of Habous and Islamic Affairs presented the conclusions of the Council's opinion regarding some issues relating to religious texts.
