The independent commission responsible for shedding light on the death of Nzoy, killed by a police officer in 2021 in Morges, says it is “scandalized” but “little surprised” by the dismissal of the case by the Vaud Public Prosecutor's Office. She criticizes the “partiality” of this decision.
This commission, founded last year and made up of specialists in law, forensic medicine and social sciences, affirms that the prosecutor in charge of the case “did not do sufficient investigative work and evacuated the question systemic racism,” she wrote Thursday in a press release.
She believes that the prosecutor grants himself “the role of arbiter which nevertheless belongs to the judges during an allegation of homicide by agents of the State.”
For the record, the Vaud Public Prosecutor's Office announced on Tuesday that it had issued an order of classification and non-entry into the matter. According to him, the police officer who fired the fatal shot acted in self-defense. The omission to render assistance cannot be held against this agent, nor against his three colleagues.
The family's lawyer has already announced an appeal to the Cantonal Court. In its press release, the commission says it supports this approach and asks that the police officers be put on trial. It also invites the Vaud Public Prosecutor's Office to “relinquish the case in favor of an authority from another canton in order to guarantee compliance with international obligations in terms of effective and impartial investigation.”
“Impunity of the Swiss racist system”
The French-speaking Justice 4 Nzoy coordination also reacted to the dismissal of the case which it considers “a political choice which shows once again to all of society that the impunity of the Swiss racist system will remain intact whatever happens” . And added that “the State will always guarantee total protection to the police […] that we always allow more to be done justice herself.”
The collective is therefore calling for a rally on December 7, 3 p.m. instead of June 14 in Lausanne, in order to demand a fair trial and the recusal of the Prosecutor.
