In Locmaria, the union council of the former Pierre et Vacances residence announces that it has won its case

The union council of the former Pierre et Vacances residence, in Locmaria, informed the 56 co-owners that the lawsuit filed in August 2022 was won. The judgment was sent at the beginning of November. The former residence is now called Marie-Galante de Locmaria.

A conflict that dates back to March 2021

The conflict dates back to March 2021, when the company Pierre et Vacances decided to sell certain common areas which belonged to the co-ownership to Ms. Weitzel and Mr. Le Corre. The Reception building is made up of parts housing installations essential to the operation of the residence: if these square meters became private, it would be difficult to properly maintain the swimming pool while respecting water quality standards, for example. Access to the switch for telephone connections and the electricity meter became impossible.

Summons not to sell were sent without obtaining a response, which led the Union Council to change trustees and take the opposing party to court.

Spaces restored to their original state

Regarding the areas claimed by the Union Council, the judge answered “Yes” to all the plaintiffs’ requests. The spaces must be returned to their original state within two months. Part of the ground floor, the staircase giving access to the basement and the entire basement become common areas again.

The separation of premises and networks (water, wastewater, electricity, telephone, , VMC), as well as the movement of the emergency stop button for the swimming pool installation are to be carried out by Ms. Weitzel and Mr. The Corre. A settlement of €6,000 euros for damages and €5,000 for lawyer's fees was obtained.

The opposing party did not appeal the judgment dated September 10, 2024, assures the union council.
