After the drowning of a little girl in the swimming pool of their rental house in 2020, the two owners were heard by the Draguignan court (Var) on October 17, 2024. Tried for manslaughter, the couple was acquitted, Thursday, November 21, the magistrates considering that no criminal offense had been committed and that they were not responsible for the death of the child, reports Var Morning .
However, the court recognized a “harm of affection” suffered by the victim's mother. It is therefore a civil fault, for which the spouses were ordered to pay €40,000 in damages.
No alarm
Prosecuted for “clearly deliberate violation of an obligation of safety and prudence”the couple had not ensured the installation of an alarm to secure the swimming pool of their rental villa, located in Vidauban.
The family, informed of the absence of this security device, had nevertheless chosen to stay in the house, indicate our colleagues. On the last day of the vacation, the little girl escaped her parents' vigilance and drowned in the swimming pool.
