This “right to make an error” means making an amended income tax return, explains Bercy on its site.

“You realize that you have provided inaccurate information, or that you have forgotten to declare a taxable bonus? You can claim the right to make an error”.

It is not a question of giving additional time to those who have not made their declaration on time or of allowing their family situation or tax residence to be corrected.

Surcharges up to 40%

It does not concern late filing of the declaration, late payments, nor for “deliberate errors, omissions or inaccuracies”. In these cases, the taxpayer is exposed to penalties.

This right only applies to those who have submitted their declaration on time. For others, the bill can be heavy. A taxpayer who has not made a declaration is exposed to a 10% increase if he ends up declaring them before receiving a formal notice.

This increase can go beyond 10%. It will increase to 20% in the event of late filing of the declaration within 30 days following the formal notice and to 40% if the declaration was filed beyond 30 days after receipt of the formal notice. Late payment interest is also applied at 0.20% of the tax due per month of delay.
