“We came close to death.” As he tells our colleagues at RMC, David is having trouble getting over it. Last March, the motorist was traveling on the A8 between Fréjus and Marseille around 5 a.m.

It’s still dark, and the rain is falling. In the distance, he sees an object in the middle of the road. He brakes, but it’s too late: “I hit this log at around 50km/h. At the time, you don’t really realize it, but in hindsight, you realize that we did well.”

The log of wood already responsible for an accident

A tow truck is sent to pick up his car, and he learns that there had already been an accident an hour earlier because of this same log, which means that it had not been evacuated in the meantime. time.

Since the accident, his car has always been stuck in the garage. The repairs are important, as is the sum: €4,000! “We find ourselves having to juggle being able to go to work, to get the children to school, to extracurricular activities. All this for a failure that is not my fault”plagues the father of the family.

What outrages him is that his insurance refuses to cover the repairs. The motorist is insured by a third party and, in the event of impact with an obstacle, he is held responsible for the accident.

Vinci must admit his fault

To be compensated, he must prove that Vinci, the company in charge of the highway, is responsible. In this case, the group’s negligence is quite clear since the log was not removed after causing an initial accident.

By contacting the RMC team, David hoped that Vinci would admit his fault. Especially since, according to his insurer, “there is no doubt that there has been a lack of normal maintenance of the road network.”

Vinci finally backpedaled by recognizing negligence and could finally pay the €4,000 in repairs.
