“An impossibility of taking care of your child”

The practitioner describes a woman “deconstructed, in denial, prey to emotional dependence after losing her mother at 11”. She also points out “ an inability to care for your child” due to his degraded mental state.

Me Klij Delilaj, one of the lawyers for the child's stepfather, will then try to sow doubt in the minds of the jurors. “If the mother had been blamed for the murder, would your conclusions have been different? » “We analyze personality. No, she wouldn't change. »

President Aurore Carpentier will then reframe the lawyer: “I remind you that the accused was never indicted for this crime. This question is off topic! » The lawyer's questioning has the gift of annoying Me Françoise Le Goardet, counsel for the mother: “It would be good to ask questions rather than statements!” »

An “unmanageable” little boy?

At the end of the afternoon, the little boy's mother was interviewed about his existence at the time and the facts. “It wasn't going well anymore, I wasn't cleaning anymore. We consumed €20 of cannabis per day. It was Gaël who took care of Eythan”specifies the one who slept during the day and lived at night.

The day before the discovery of Eythan's lifeless body, July 9, 2022, she got up around 5 p.m. His partner tells him that the child is taking a nap, that he has been unmanageable » and he has it “typed” and also that the boy “hurt himself”. The course of the evening remains confused, as do the memories. Both consume alcohol, cannabis, antidepressants. He mixes this already explosive cocktail with methadone, sometimes heroin, anxiolytics…

She tries to warm the child

The next day, when the mother got up, her companion reported that the little boy “didn’t eat, he’s sick”. She enters the room. “Eythan no longer moved, she sobbed. He was cold and had dried blood around his mouth. His lips were blue. » She tries to warm the child, before they call for help.

According to him, Gaël Scoubart had previously observed twice that the child did not wake up without being unduly worried. Could he have saved him? The question remains. According to the emergency services on site on the day of the macabre discovery, she told him: “What did you do to my baby?” »

The police will testify that the mother is crying, seems lost, asks for her phone which remains in the little boy's room. As for the stepfather, he shows no interest in the child. “He just wanted to walk his dog”reports the president of the Assize Court.

A body position that questions

Me Thomas Jourdain-Demars, second lawyer for the father-in-law, will return to the charge. In pre-trial detention, the woman sent a letter stating that she still loved him. “Any mother would have stopped loving the murderer of her child…” The answer is scathing. “But I’m such a terrible mother. Does that surprise you that much? » Did she think he intended to kill her son? “On the one hand, I tell myself that he couldn't have done it. On the other hand, Eythan is dead. »

Me Le Goardet will then ask him this question: “When you entered his room, what was your son’s position? » The mother assures him: “He was off to the side. » For the record, the forensic doctors had pointed out that the little boy had died since “at least twelve hours before help arrives”positioned on the stomach.

After a long hearing lasting almost twelve hours, the president of the court will read the transcription of a telephone conversation between the mother and her father, while she was in pre-trial detention. “I got up that night. I saw him put Eythan in his bed. It's a staging. How did he see him do that? »

The debates continue this Wednesday, November 13, including the questioning of the accused on the facts and the hearing of the psychologists who examined him.
