Orléans Court of Appeal
On November 27, 2020, Mourad went to the Paul-Louis-Courier elementary school in Chambray-lès-Tours in order to obtain an explanation with the director of the establishment. His 8 year old nephew is considered a “disruptive” since kindergarten.
That same day at 3:40 p.m. a man wearing a khaki down jacket with fur agitated behind a window of the school, appeared aggressive, stared at the principal in the eyes and shouted at him “I’m going to go over the fence and take your brains out”.
Arrested the next day, the person concerned explained that he had made the decision to pick up his nephew from school, had wanted to meet the director to discuss, and denied any death threat, claiming that the director had misinterpreted his words: “I got carried away, but I told him I’m waiting for you, not I’m knocking out your brains. »
Mourad specifies at the bar: “My brother doesn't take care of his son, I regret this misunderstanding, that was not my intention. I should have made an appointment, I regret these facts. »
Under electronic surveillance
His criminal record includes nine entries between 2006 and 2023. He was notably sentenced to two years in prison in 2007 for drug trafficking.
The general advocate, Isabelle Pagenelle, emphasizes that the child has since changed schools and that everything is going well. Did the caller's words go beyond his thoughts? Certainly, they are pronounced in a context of irritation and the director was afraid in the exercise of his functions. The thirty-year-old has not committed a new offense for four years, the magistrate requires confirmation of six months.
For the school principal, Me François-Antoine Cros reports that his client experienced this episode painfully. A witness explains that this altercation lasted half an hour. “The problems did not come from this school, it is intolerable, nothing can justify this violent reaction. »
In defense, Me Magali Castelli-Maurice exclaims: “Threats yes, death threats no. » The lawyer specifies that the child is a “hyperactive, very good student and who has good relationships with adults but who has difficulty with graphics”. For his advice, a firm sentence is not appropriate. “Since 2018, there has been no more file. » She recommends a reduction in sentence, “so that he is only condemned for what he has done.”
The court confirms the six-month sentence at the beginning of October 2024 but says that it will be executed under electronic surveillance at home.
