Nadine Oliveira, the 54-year-old driver of the bus, will be tried again for homicide and involuntary injuries. Will she be present at his trial? During the first instance hearing, the fifty-year-old was hospitalized after the first week. It continued in his absence to the great dismay of the civil parties: the parents of the victims and the survivors injured and forever marked by this tragedy.

At the end of three intense weeks, in a huge room intended for extraordinary trials, the driver was found guilty of “lack of inattention and imprudence” andhomicides and involuntary injuries, she had been sentenced to five years in prison, four of which were suspended. Despite visual testimony and expert opinions, she never admitted to having forced the level crossing.
